AccessResolve

AccessResolve Property Mediation

A property dispute resolution service for court-ordered clients, delivered since 2012 by Relationships Australia Victoria on behalf of the Federal Circuit and Family Court of Australia (FCFCOA).

About our service

AccessResolve assists separating parties who have begun proceedings in the FCFCOA to participate in property dispute resolution (mediation). Supported by an independent mediator, parties engage in robust and comprehensive negotiations designed to help them reach a financial and property settlement agreement.

Parties can attend with their legal representative, or on their own if self-represented.

Mediation may be online or in person, depending on each party’s circumstances.

Possible outcomes

  • Parties reach agreement in mediation. This may result in a final property or financial settlement that can be made into ‘orders by consent’ in court.
  • Parties resolve some, but not all, matters in dispute. This helps to narrow down the issues that need to be decided by the court.
  • Parties are unable to resolve matters in mediation. In this situation, the mediator will refer the matter back to the court for resolution. 

 

Eligibility

You must be ordered by the FCFCOA to be able to use our AccessResolve Property Mediation service.

If you don't have a court order to attend AccessResolve mediation, you may be able to access our family dispute resolution (FDR) service.

 

Getting started with AccessResolve

Your court order will contain details about:

  • how to contact us to arrange your mediation
  • fees and how to organise payment to the FCFCOA (payment cannot be made directly to AccessResolve)
  • which documents you need to provide before your mediation session.

The safety of our clients and staff is our priority. To ensure that your service experience is safe and appropriate, please send us a copy of any current or previous family violence intervention orders before your mediation begins.

 

About our mediators

AccessResolve mediators are:

  • accredited by the Attorney-General’s Department as Family Dispute Resolution Practitioners
  • experienced in property and financial disputes
  • qualified legal practitioners.
